Notice is hereby given that the City of Biloxi, Mississippi, will receive sealed bids at the Mayor’s Office, City Hall, second floor, until 4:00 p.m. on Wednesday, the 8th day of September 2021, for the following:

Sidewalk and Concrete Maintenance

Work on which proposals are invited consists of the repair and/or replacement of sidewalks and concrete for the City of Biloxi. Due to the nature of this contract, the exact scope of work is unknown at the time of bidding and may include, but is not limited to riew construction, mainly sidewalks, driveways, low traffic concrete streets, curbs and gutters for the City of Biloxi. Work may also include removal and replacement work. No minimum or maximum amount of work is guaranteed. Concrete tasks will be ordered by individual purchase orders which will include drawings, specifications, and administrative details such as period of performance and start date unique to each task.

The City will select a “Primary” Contractor and a “Secondary” Contractor to award contracts based on the two (2) lowest and best bids. Work shall be assigned first to the Primary Contractor and if the Primary Contractor cannot meet the performance schedule of any task, the City may assign the task to the Secondary Contractor.

The contract shall end December 31, 2021 for the basic period. The City of Biloxi, at its sole discretion, may extend the contract time by approving up to five (5) separate option periods of up to six (6) months each. If exercised, the first option period shall end June 30, 2022; If exercised, the second shall end December 31, 2022; If exercised, the third shall end June 30, 2023; If exercised, the fourth shall end December 31, 2023; And if exercised, the fifth shall end June 30, 2024.

The schedule of estimated contract items and unit prices provided in the proposal shall apply to the basic period and the first option period, if exercised by the City. If requested by the Contractor, unit prices may be adjusted on a yearly basis during the second and fourth option periods, by applying the CPI factor to the prices bid for the basic period.

Work under the Contract will be issued by means of purchase orders as work is identified and authorized by the City Engineer (the “CE”) or the CE’s authorized representative. Each Task will be classified as either standard or emergency. Construction drawings may or may not be issued with purchase orders. Contractor shall be capable of taking orders and directions from the CE or CE’s authorized representative for repair or replacement methods and limits for repair or replacement for individual Tasks. Contractor shall be familiar with standard repair methods. The contractor’s superintendent(s) and crew(s) shall be experienced and capable of performing maintenance tasks in a timely and workmanlike manner.

The Contractor shall be available to start work as soon as the City issues a written order to commence work (Notice to Proceed). Contractor shall be on standby and ready to respond during the entire length of the contract. Work on each emergency task shall commence within two (2) hours and work on each standard task shall commence within ten days. Liquidated damages will not be charged for this work, but failure to respond to or complete work within the required time will be considered in authorizing additional work. Location of said work is in Biloxi, Mississippi.

A PRE-BID MEETING will be held at 1 P.M. on Thursday, August 19, 2021 at the City of Biloxi Engineering Office Conference room. It is strongly recommended that all prospective Bidders attend. It is also suggested that all potential subcontractors and interested parties attend.

All persons having a contract with the City of Biloxi must adhere to the City’s policy concerning non- discrimination on the basis of race, color, religion, sex, age, sexual orientation, gender identity, national origin, veteran or disability status.

A Certificate of Responsibility number issued by the Mississippi State Board of Contractors shall be written on the outside of the envelope containing the bids. When bids are submitted electronically, the requirement for including a certificate of responsibility on the exterior of the bid envelope shall be deemed in compliance by including the same information as an attachment with the electronic bid submittal.

Bids, which are for work outside of the classification listed for any bidder, shall be returned unopened.

Bid documents are being made available via paper copy or digital copy (CD). Plan holders are required to register for an account and log-in at www.biloxiplans.com; at this site plans can be viewed for no charge or physically purchased. All plan holders are required to have a valid email address for registration. Purchased bid documents are non- refundable and must be purchased through the website. A view only copy of the plans, specifications, and proposal documents are also available to be viewed at the City of Biloxi Engineering Department, which is located at 214 A Delauney Street, Biloxi, Mississippi (the Public Works Building), (228) 435-6269. Plans and specifications may be examined without charge online or at the City of Biloxi Engineering Department during regular business hours (7:00a.m.- 4:00p.m., Monday- Friday).

Contractors have the option of submitting their bids sealed in an envelope or through the City’s electronic bid submission link at www.biloxiplans.com.

Preference shall be given to resident contractors, and a nonresident bidder domiciled in a state, city, county, parish, province, nation or political subdivision having laws granting preference to local contractors shall be awarded Mississippi public contracts only on the same basis as the nonresident bidder’s state, city, county, parish, province, nation or political subdivision awards contracts to Mississippi contractors bidding under similar circumstances. In order to ensure that Mississippi’s so-called Golden Rule is followed, state law requires a non-resident bidder to attach to his bid a copy of his resident state’s current law pertaining to such state’s treatment of non-resident contractors. Resident contractors actually domiciled in Mississippi, be they corporate, individuals or partnerships, are to be granted preference over nonresidents in awarding of contracts in the same manner and to the same extent as provided by the laws of the state, city, county, parish, province, nation, or political subdivision of domicile of the nonresident.

The ability to obtain any insurance required by the contract documents must be demonstrated in the bid by the means specified in the contract documents. Proof of actual insurance coverage must be submitted within five (5) business days from the bid acceptance.

In compliance with the laws of the State of Mississippi, in choosing materials for the project, the successful bidder shall be required to give preference to materials grown, produced, prepared, made or manufactured within the State of Mississippi. The foregoing notwithstanding, no preference shall be given to materials grown, produced, prepared, made or manufactured in the State of Mississippi when other materials of like quality produced outside the State of Mississippi may be purchased or secured at less cost, or any other materials of better quality produced outside the State of Mississippi can be secured at a reasonable cost. The Contractor shall not use any materials on the project that are grown, produced, prepared, made or manufactured outside of the United States. If such materials are not available, then those which are grown, produced, prepared, made or manufactured outside the United States may be used.

BIDS SHALL BE DELIVERED TO THE MAYOR’S OFFICE, SECOND FLOOR, CITY HALL BUILDING, 140 LAMEUSE STREET, BILOXI, MISSISSIPPI, 39530, OR ELECTRONICALLY SUBMITTED AT WWW.BILOXIPLANS.COM.

Bids shall be in letter form with the envelope or electronic attachment and bid marked plainly Sidewalk and Concrete Maintenance,. and shall be addressed to the Mayor’s Office, P.O. Box 429, Biloxi, Mississippi 39533. Inaddition, the envelope or electronic attachment shall list the Company Name and Address, Certificate of Responsibility, and all applicable state and local license numbers.

The City reserves the right to reject any and all bids and to waive any informality in the proposal accepted. No bidder may withdraw his bid within 60 days after the actual date of the opening thereof.
